1. Who We Are
Evodince GmbH is a software and services company incorporated in Austria, headquartered in Salzburg. We operate two lines of business:
Evodince-branded email newsletters, newsletters and other content delivered directly to subscribers via email.
Custom-curated newsletters and briefings created and distributed on behalf of organizations, companies, advocacy groups, and similar entities.
We are independently owned, self-funded, and committed to privacy, ethical communication, and client-focused value.
2. Use of Our Services
You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to:
Access or use the Services in any way that violates applicable law or regulation (including data protection, export control, and intellectual property laws).
Copy, reproduce, redistribute, or commercially exploit content from our Services without prior written permission.
Attempt to disrupt, damage, or gain unauthorized access to our systems or networks.
3. Subscriptions and Payment
Certain Services are available through paid subscriptions. Pricing, billing, renewal, and cancellation terms are available on our Pricing page or are provided during the purchase process.
For custom briefings and third-party newsletter campaigns, subscription or service terms are outlined in a separate written agreement between Evodince and the client.
4. Third-Party Content and Services
Our newsletters often include links to or excerpts from third-party sources, including news articles, interviews, government documents, and other publicly available information. While we strive to ensure high-quality curation, we do not control or endorse third-party content and are not responsible for its accuracy, completeness, or availability.
Some newsletters may be created and distributed on behalf of third-party organizations. In these cases, Evodince acts as a communications service provider and does not necessarily endorse or verify the opinions, positions, or content published in those client-owned newsletters.
5. Intellectual Property
All original content provided through the Services, including text, layout, branding, and newsletter format, is the property of Evodince GmbH or its licensors and is protected by copyright and other intellectual property laws.
You may not modify, reproduce, distribute, or create derivative works from our content without our explicit written permission, except as allowed under fair use or applicable law.
6. Privacy and Data Use
We take privacy seriously. Our collection and use of personal data is governed by our Privacy Policy. We do not sell or share subscriber data with third parties, and we comply with all applicable data protection laws, including the General Data Protection Regulation (GDPR).
Custom newsletter clients may provide us with subscriber lists or usage data under a data processing agreement. In such cases, we act as a data processor and do not retain or repurpose that data for any other purpose.
7. AI-Generated or Assisted Content
Some content within our newsletters or briefings may be generated or refined using AI tools provided by GDPR-compliant providers. These tools are used to enhance clarity, structure, and formatting, not to make automated decisions about individuals. We clearly label AI-generated content when it constitutes a substantial part of any given output.
We comply with applicable transparency and usage requirements under the EU AI Act.
8. Availability and Changes to Service
We strive to maintain uninterrupted access to our Services, but we cannot guarantee availability at all times. We reserve the right to modify, suspend, or discontinue any part of the Services at our discretion.
We may also revise these Terms periodically. When we do, we will update the “Last updated” date above. Continued use of our Services after any such changes constitutes acceptance of the revised Terms.
9. Termination
We reserve the right to suspend or terminate access to our Services if we believe you have violated these Terms or engaged in unlawful or abusive conduct.
10. Disclaimer of Warranties
All Services are provided “as is” and “as available” without warranty of any kind, either express or implied. We disclaim all warranties to the maximum extent allowed by law, including but not limited to fitness for a particular purpose, accuracy, or non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law, Evodince GmbH and its officers, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Austria. Any disputes arising from or related to these Terms or the use of our Services shall be subject to the exclusive jurisdiction of the courts of Salzburg, Austria.
